Trucking Accidents Lawyer: 2 South Carolina Trucking Companies Declared ‘Imminent Hazards To Public Safety’
In late December, the U.S. Federal Motor Carrier Safety Administration, the arm of the U.S. Department of Transportation that regulates trucking companies, took the somewhat unusual step of declaring two South Carolina truck companies to be “imminent hazards to public safety.” Each has now been served with a federal shut-down order.
The two companies, Edward Risher Trucking and CER Trucking, are based in Walterboro. They transport general freight and refrigerated food across South Carolina and throughout the southeastern portion of the U.S.
In late November, the son of CER Trucking’s owner was driving one of the company’s trucks in Virginia when he lost control, swerved into oncoming traffic and caused a car crash that left one person dead. He did not have a commercial driver’s license at the time (it was suspended in 2010) and has now been charged with several offenses, including possession of alcohol while driving, operating a commercial motor vehicle while disqualified and reckless driving.
That accident caused the FMCSA to open an investigation into Edward Risher Trucking, the company owned by the driver involved in the fatal accident. That investigation found that Risher Trucking did not take adequate steps to ensure that its drivers could operate commercial vehicles safely; one was medically prohibited from driving and another had disqualifying marijuana-related offenses.
